Federal Law on Visitation

The federal law governing the regulation of nursing homes is called the Nursing Home Reform Act of 1987. The Act states that the resident has the right and the facility must provide immediate access to any resident of the immediate family or other relatives of the resident, subject to the consent of the resident. Under the Act, other visits are subject to "reasonable restrictions" and resident consent. Consumers should note that the "reasonable restrictions" shall not apply to immediate family and other relatives of the resident . The Act also states that the institution must provide "reasonable access" to persons who provide health, social or legal services to residents. These provisions of the law clearly supports the right of a resident to have access to persons of their choice.
